TERMS AND CONDITIONS

11. WARRANTY

11.1 The materials used in the manufacturing of railings, balconies, and exterior coverings made exclusively of aluminum are guaranteed by the Contractor for 20 years. This Warranty applies to any defect in the quality of the raw material (aluminum) resulting from a manufacturing or design defect when the design is carried out by the Contractor. It expressly excludes:

a) Any installation or maintenance defect;
b) Color alteration of materials caused by weather or ultraviolet rays;
c) Glass railings;
d) Fiberglass;
e) Balcony sealant joints;
f) Door welds;
g) Hinges and latches;
h) Automatic door closing mechanisms;
j) Labor, including but not limited to travel, transportation, removal, and reinstallation costs.

11.2 The Contractor offers a 5-year warranty on fiberglass balconies and stairs, except for structural fiberglass balconies, which are covered for one (1) year only. This warranty applies only to materials and expressly excludes labor.

No warranty will apply to fiberglass that has been drilled or improperly maintained. The Client agrees to regularly inspect and maintain sealant joints to prevent water infiltration and premature wear.

11.3 The Client and any subsequent purchaser agree to regularly inspect and maintain sealant joints to prevent water infiltration and premature wear.

No warranty will apply if the Client installs a privacy screen of any kind, as this may cause cracks or damage to the sealant and/or fiberglass due to post movement caused by wind.

11.4 The Client agrees to notify the Contractor in writing within fifteen (15) days of discovering any defect, including cracks in the fiberglass, or any breakage or damage of any kind. This written notice must be sent to Les Aluminiums Williams inc., at 119 rue des Pins Ouest, Saint-Alphonse-de-Granby, Quebec, J0E 2A0, by registered mail.

Under this warranty, the Contractor is not required to replace fiberglass balconies in full.

11.5 The Client acknowledges that the colors of hardware components and paint may vary from one piece to another. Likewise, if new parts are provided under this warranty, the Client acknowledges that the color of the parts and/or paint may differ from those already in their possession.

Furthermore, the Client acknowledges that any fiberglass repair may result in a color variation.

11.6 To maintain the validity of this warranty, the Client and any subsequent purchaser must follow the maintenance instructions below:

  • Maintain and replace sealant joints as needed;

  • Clean surfaces using a grease-cutting dish detergent (no abrasive products);

  • Use a soft (non-metallic) brush;

  • Note that metallic objects may leave permanent rust stains on fiberglass;

  • Move objects placed on balconies and railings to prevent uneven discoloration;

  • Do not drill into the fiberglass;

  • Use only non-corrosive sand or salt for de-icing;

  • Do not place carpets or other items that retain moisture directly on the fiberglass.

11.7 The Client agrees to inform any subsequent buyer, property owner, or user of this warranty and its terms to ensure proper maintenance of materials and installations, and guarantees full disclosure.

11.8 No warranty applies to glass components.

11.9 The Client or general contractor is responsible for readjusting slopes in the event of normal building settlement over time. The Client or contractor must ensure that balconies maintain at least a 1% slope.

11.10 No warranty applies in cases of frost heave affecting foundations (piles, sonotubes, etc.).

12. EXCLUSIVE RESPONSIBILITY OF THE CLIENT

12.1 Mounting bases and supports for product installation must be adequate to allow proper anchoring in compliance with applicable standards. It is the Client’s sole responsibility to provide adequate and compliant supports, to the full exclusion of the Contractor.

12.2 Les Aluminiums Williams inc. disclaims all liability regarding the strength and compliance of products installed on an inadequate structure provided by the Client and/or a third party. The Client agrees to hold the Contractor harmless and indemnify it against any claim arising directly or indirectly from the non-compliance of such a structure, including the mounting bases and supports used for installation.

12.3 Les Aluminiums Williams inc. disclaims any liability for cracks in concrete or chipped ceramic tiles that may occur during installation.

13. SPECIAL CLAUSE REGARDING NON-COMPLIANCE WITH PLANS AND/OR SPECIFICATIONS

13.1 The Client acknowledges and expressly declares that they have requested and required from Les Aluminiums Williams inc. (hereinafter the “Contractor”) the products and materials (hereinafter the “Request”) listed in this contract, even if this Request differs from the project’s plans and/or specifications (hereinafter the “Plans and/or Specifications”), and hereby releases the Contractor from any liability arising from non-compliance with said Plans and/or Specifications.

It is the Client’s sole responsibility, to the full exclusion of the Contractor, to obtain approvals, certifications, and authorizations required as a result of the Request and its deviation from the Plans and/or Specifications.

By signing this document, the Client — including its directors, shareholders, employees, related companies, subsidiaries, insurers, agents, officers, successors, heirs, and assigns — irrevocably waives all rights and claims against the Contractor, its representatives, and affiliates, directly or indirectly arising from non-compliance with the Plans and/or Specifications or from the Request itself.

14. ACCEPTANCE OF TERMS

The Client accepts the terms and conditions stated above, declares satisfaction with these terms, acknowledges that they were not imposed, and confirms having had the opportunity to seek independent advice before signing this contract.
